More commercial lawsuits, November 2009 – those that did not make the paper

The following lawsuits have been filed in Chelan County Superior Court. Plaintiff is listed first. Readers are cautioned that claims in these actions have not been proven; they are alleged to be causes for actions and their truth will be determined at trial.
France & Co. v. Rachel Jaffee, City of Wenatchee
France & Co., filed a complaint Sept. 23 against Rachel Jaffee and the City of Wenatchee claiming that it has not been paid for work completed on an emergency cleanup to Jaffee’s home due to a sewer backup.
The amount due is $5,611.21 plus interest at 12 percent.
Plaintiff has filed a lien on the property and asks for payment or foreclosure on the property. No response filed. Attorney for plaintiff is Danielle Marchant.
Don’s Painting LLC v. Halme Builders Inc., Chelan County, Travelers Casualty & Surety Company of America
Halme Builders Inc. hired Don’s Painting to work on the Wenatchee River Park Restroom.
In a suit filed Oct. 2, Don’s Painting claims Halme Builders only made partial payment for the completed work and owes $7,615.04 plus interest.
Don’s Painting has filed a claim against the bond issued by Travelers Casualty and asks that either bond or defendant pays the balance due plus interest and attorney’s fees.

Robert and Sharon Hansen v. J.S. Vail LLC doing business as M. Vail Company, and Cashmere Valley Bank
Robert and Sharon Hansen accepted a Feb. 23, 2009, bid from J.S. Vail LLC to work on their property at 410 Washington St., Wenatchee.
On Oct. 5, the Hansens filed a lawsuit claiming J.S. Vail did not complete the work in a professional and workmanlike manner and as a result, the Hansens hired a replacement contractor to complete the deficient work on the roof, which cost them an additional $6,647.40.
The Hansens are seeking payment from J.S. Vail or the company’s savings account held by Cashmere Valley Bank, plus reasonable attorney’s fees and costs. No response filed. Attorney for the plaintiff is Thomas O’Connell.
Marson & Marson Lumber Inc. v. Michael and Jane Doe Tutino, doing business as Tutino Construction, and RLI Insurance Company
Marson & Marson Lumber Inc. filed a complaint Oct. 5 against Michael Tutino for failure to pay for supplies and materials sold to Tutino on an opened he opened in the past year.
As of Sept. 28, 2009 the balance due on the account was $14,080.43 at an interest rate of 12 percent.
Plaintiff seeks payment plus interest due and reasonable attorney’s fees and costs. No response filed. Attorney for plaintiff is Thomas O’Connell.
C&O Nursery Inc. v. Walter and Jane Doe Harvey
C&O Nursery filed a complaint Oct. 13 alleging Walter Harvey did not pay for hundreds of fruit trees delivered on April 3, 2009. C&O claims Harvey agreed to pay at total of $4,139.63 for the trees, but made only an initial payment of $200.
C&O Nursery is asking for the balance of $3,934.63 plus interest at $1.30 per day, and reasonable attorney’s fees and costs. No response filed. Attorney for plaintiff is Julie Norton.
T & T Electric Inc. v. Michael and Margaret Wagner, Mortgage Electronic Registration Systems Inc., Key Bank National Association
Michael and Margaret Wagner hired T&T Electric in April or May 2009 to supply labor and materials for improvements to their property. T&T Electric Inc. filed a complaint Sept. 23 alleging the Wagners have not paid the balance due of $40,257.73 plus interest and costs.
T&T Electric recorded a claim of lien on the property with Chelan County.
Plaintiff asks for payment or foreclosure on the property. No response filed. Attorney for plaintiff is James Denison.
