More commercial lawsuits, December 2009

The following lawsuits involving local businesses have been filed in Chelan County Superior Court. Plaintiff is listed first. Readers are cautioned that claims in these actions have not been proven; they are alleged to be causes for actions and their truth will be determined at trial.
Northwest Wholesale Inc. v. Epigmenio and Jane Doe Casteneda
Epigmenio Casteneda opened a credit account with Northwest Wholesale Inc. in April 2007. Northwest Wholesale claims it has a balance due of $1.959.09, plus interest accruing at 18 percent. Plaintiff seeks payment and reasonable attorneys fees and costs. Attorney for plaintiff is Thomas C. O’Connell. The complaint was filed Nov. 5. No response filed.
Marson & Marson Lumber Inc. v. Terence and Patricia Bolinger, Linrich Inc. doing business as
Linrich Construction & Remodel, CBIC, RLI Insurance Co.
Terence and Patricia Bolinger and Linrich Inc. opened an account with Marson & Marson Lumber in June 2007 to supply materials for construction at 3101 Chelan Place, Manson. Marson & Marson claims defendants have failed to make payments on the balance, which as of Sept. 18, 2009, was $45,644.83 with interest accruing at 12 percent. Marson & Marson ceased providing materials on Feb. 19, 2009, and filed a lien on the property on April 24. CBIC and RLI have both issued bonds to the defendants. Plaintiff seeks payment on account, foreclosure of lien, interest due, and reasonable attorneys fees and costs. Attorney for plaintiff is Andrew Kottkamp. The complaint was filed Oct. 29. No response filed.
Wheatland Bank v. CCDC Inc., Anaplex Corp., Charles Colmenero Jr. and Bernard Kerper
Wheatland Bank filed a complaint against CCDC Inc., Anaplex corp., Charles Colmenero Jr. and Bernard Kerper for default of payment on a line of credit account that was opened Feb. 15, 2008. Defendants Colmenero and Kerpers personally guaranteed repayment of the note, which had a 6.99-percent interest rate. Wheatland claims they made one principal reduction payment but have failed to pay the balance due of $305,081.05. Plaintiff asks for balance due or foreclosure of secured collateral plus attorneys fees and costs. Attorney for plaintiff is Michael K. Staub. The lawsuit was filed Oct. 23. No response filed.
