Commercial lawsuits, December 2009

The following lawsuits involving local businesses have been filed in Chelan County Superior Court. Plaintiff is listed first. Readers are cautioned that claims in these actions have not been proven; they are alleged to be causes for actions and their truth will be determined at trial.
Diane Haney v. Lake Chelan Recreation Inc., doing business as Lake Chelan Boat Co., and John Does 1-X
Diane Haney claims she was injured during an Oct. 18, 2006, ferry boat ride operated by Lake Chelan Recreation Inc. Haney’s lawsuit states that during a cruise of Lake Chelan, she was struck in the upper neck and back by a stack of deck chairs that had come loose on the boat. She claims Lake Chelan Recreation was negligent and is asking for general damages, medical expenses, emotional distress, pain and suffering, and reasonable attorneys fees and costs to be determined in court. Attorney for plaintiff is Anthony Castelda. The complaint was filed Oct. 15. No response filed.
Alta Fresh Inc., doing business as Chelan Fresh Marketing v. Epicor Software Corp.
Alta Fresh Inc. filed a complaint against Epicor Software Corp. stating that Epicor provided software to them that did not meet its needs as promised. The suit states Epicor sent Alta Fresh an engagement letter on July 28, 2008, seeking Chelan Fresh’s approval to install a software system. Prior to signing the letter, Doug Ballard, Chelan Fresh’s head of IT, visited Epicor in Irvine, Calif., and was shown demonstrations, models and reports, and was assured by Epicor that the software would meet Chelan Fresh’s needs. Plaintiff states the software was installed and Chelan Fresh notified Epicor of problems but Epicor has not done anything about them. Plaintiff seeks damages to be determined at trial. Attorney for plaintiff is Jay A. Johnson and J.P. Deiner. The lawsuit was filed Nov. 5. No response filed.
US Online.com Inc. v. Stephen and Jane Doe Peters
US Online.com Inc. filed a complaint Nov. 20 against Stephen Peters alleging breach of contract. The lawsuit states that Peters, who lives in California and does business as “Way2SlickAdvertising,” signed a contract to sell US Online.com’s advertising to third parties. Peters was trained by US Online.com and given customer information to do the job. In September 2009 US Online claims it discovered that Peters had been attempting to and did sell competing products to US Online customers and encouraged other US Online dealers to do the same. US Online terminated the contract, but claims the defendant persisted in these actions and has caused damages exceeding $250,000. Plaintiff asks for principle amount, interest, reasonable attorneys fees and costs, and an injunction restraining Peters from further breaches of contract. Attorney for plaintiff is Mark Peterson. No response filed.
